Planning Conditions

back to News

Very often I find that a planning permission comes with significant ‘Conditions’. As the word suggests, the existence of the planning permission depends entirely on the applicant fulfilling the requirements of the LPA – the ‘conditions’.

Frequently they are fairly innocuous, but sometimes they can be completely infuriating. There is often little you can do (at least you have planning permission!) but it is possible to appeal against them. This, obviously, is expensive in time and (usually) money. I have a case in point that I am dealing with now.

It relates to a re-vamped existing dairy unit, where an increase from 200 to 300 cows is planned. Previously the cows have been kept inside all the time, and the buildings are extremely ‘tired’…. A fundamental change is happening, in that the herd will now be predominantly outside. The slurry lagoon is staying, but there is to be a new cubicle shed, new parlour / collecting yard, and new silage clamps.

Amazingly, the planners have insisted that a pre-commencement condition is applied to conduct an odour assessment. The only nearby residents are two herdsmen and three other cottages – all owned by the farm. The consultant who has done the assessment thinks it is ridiculous, but in the interests of getting on with it (an appeal would take many months) we can only argue – but eventually comply.
